This is the human interest story of a couple with a 3year old child who financed through FMI First Mortgage Investments P/L & were thrown out of their home because of misuse of due process by the court system & finance providers
The owners of the home in Hunter St Torbanlea obtained a loan from First Mortgage investments Pty Ltd acting for First Mortgage Management Investments Pty Ltd
The local FC bailiff was instructed under a warrant obtained by First Mortgage Investments Pty Ltd which was in question by the home owners as to its validity & legality but still was acted on by the bailiff
The issue of the warrant was raised well prior to the home seizure by First Mortgage Investments Pty Ltd via the Fraser Coast bailiff by Holly Towler co-owner of the Hunter St home.
Whilst the question of the validity of the warrant was in question the actions of the Fraser Coast bailiff under instructions of First Mortgage Management Investments Pty Ltd were inappropriate to the extreme say the Hunter St home owners Holly Towler & Mario Guerra.
Furthermore there appeared to be an issue between Holly Towlers partner Mario Guerra and the bailiff in that earlier a good behavior order was placed to not allow the above two parties to be within 200 metres of each other without incurring the wrath of the courts & face arrest….Yet>> one of the parties totally disregards the court order apparently with not only impunity of punishment & arrest but becomes the law unto himself & engages the services of the local constabulary in assisting him in his misdeeds & total disregard of the court order from a court by which he has been engaged.
On the face of it , it would seem that this action & total disregard of court orders by court workers taints the very court system on which we as tax payers rely on to serve & protect-
It happened that the bailiff had contravened the order to not approach the co-home owner Mario Guerra under the court order & gave scant regard to the court order or the conditions & penalties therein for any breach by himself. Does that mean that as a bailiff you can totally disregard court orders because you are employed by the courts & that court orders are for the peasants & not for court workers, despite the judges rulings???
Mario Guerra says of the bailiff who was said to have disregarded the court order>>
“I AM THE COURT BAILIFF, THEREFORE THE RULES OF THE LAND & COURTS DO NOT APPLY TO ME AS I AM ABOVE THE LAW.”
The judge who made the ruling needs to be advised of this breach & take the appropriate actions
It has been expressed to us by the Hunter St home owners that the alleged thuggery of the action of the bailiff & First Mortgage Investments acting for First Mortgage Management Investments Pty Ltd was an abuse of how the justice system works or is supposed to work
